County-Level Exceptions Investors Should Know
Statewide rules only tell part of the story. These county-level quirks catch out-of-state investors off guard.
New York County/Kings/Queens/Bronx/Richmond (NYC)
NYC conducts In Rem tax foreclosure through the NYC Department of Finance — a separate administrative proceeding from standard mortgage foreclosure. Buyers of a tax-foreclosed property in NYC receive a deed directly from the city. Both the judicial mortgage foreclosure chain and the NYC Finance tax foreclosure chain must be searched and reconciled.
Nassau County
Nassau County has the most active property tax grievance process in the US. Pending tax certiorari proceedings (tax assessment challenges) can result in refunds to the former owner — but if the property was foreclosed during the proceeding, the refund disposition is contested. Buyers should check for open certiorari proceedings in both Supreme Court and the Assessment Review Commission.
Suffolk County
Suffolk County has a significant volume of properties with open building permits and certificates of occupancy defects — particularly for additions and pools built without permits. These violations are municipal in nature, are not extinguished by foreclosure, and must be cured by the new owner before a new CO can be issued.
